Annual Notice of Student Rights Under FERPA

Student & Parental Rights

The following rights have been granted to students and/or the parents of dependent minors under FERPA. These rights pertain to the access and disclosure of any personally identifiable information (PII) published in a student’s official education record maintained by our institution.  Furthermore, the procedures for exercising these rights are explained.

 

Students and the parents of dependent minors hold the following rights as authorized under FERPA.
 

  1. Right to Review
    Students and parents of dependent minors have the right to review a student’s education record.

    1. The student must submit a request, in writing, to the school official in charge of maintaining student records. The request must specify which record(s) the student wishes to review.

    2. The school has 45 days to furnish the student with a copy of the record or make arrangements for the student to review the original document. If the student submitted the request to the incorrect official, then that official will notify the student of the proper official to submit the request to.

  2. Right to Amend
    Students and the parents of dependent minors have the right to request an amendment be made to a student’s education record.

    1. If the student believes his/her record is inaccurate, misleading, or otherwise in violation of the student’s rights granted under FERPA, the student may request that the record be amended.

    2. The student must submit a written request to school officials stating why the record(s) are incorrect, attaching relevant support documents, and specifically identify  how the record should be amended.

    3. School officials will review the student’s request and supporting evidence and render a decision.

      1. If the school chooses to honor the student’s request, the student will receive notification in writing  and a copy of the corrected record.

      2. If the student’s request is denied, school officials will notify the student of this decision and of their right to request a hearing concerning the amendment request.

    4. If the student chooses to request a hearing, school officials will inform the student of the procedures for conducting the hearing.  School officials will inform the student of the date and time of the hearing as well as the timeframe for a final decision.

  3. Right to Consent
    Students and the parents of dependent minors have the right to grant their written consent to the school before any personally identifiable information from the student’s record is released to any third party.

    1. The student must submit  the official release document to the school authorizing the school to release information to a designated third party. 

      1. School officials will provide students with the proper form to authorize the release of information.

    2. Exception
      The only exception to this provision is for school officials with legitimate educational interest as authorized under FERPA.

      1. A school official has legitimate educational interest if the official needs to review an education record to fulfill  his/her professional responsibilities for the school.

  4. Right to File a Complaint
    Students and the parents of dependent minors have the right to file a complaint with the US Department of Education  concerning alleged failures by the school to comply with FERPA.

School Responsibilities

Our institution is responsible for the following actions under FERPA.  These responsibilities pertain to the access and disclosure of any personally identifiable information (PII) published in a student’s official education record maintained by our institution.
 

  1. Notice of Rights
    The school will release an annual notification of rights, regarding their education records, to every student actively enrolled in the barbering program at the time of publication.

    1. The school will explain the procedures necessary for students to exercise these rights in its annual notification.

  2. Record of Access
    The school will maintain an ongoing record of whom a student’s PII was disclosed to and the legitimate interest the part(ies) had in obtaining the information.

    1. Exclusion
      School officials with legitimate educational interests are excluded from this provision.

  3. Obtain Authorization
    School officials will  not release any PII or other information from a student’s file to a third party without obtaining prior written consent from the student and/or parent of dependent minors.

  4. Accreditor Access
    Our school is accredited through the National Accrediting Commission of Career Arts & Sciences (NACCAS).  As such, NACCAS has the right to access a student’s file without obtaining prior written permission from the student and/or parent(s) of a dependent minor.

  5. State Regulatory Authority Access
    Our school is approved to operate as a secondary school by the SC Commission on Higher Education.  As such, this agency has the right to access a student’s file without obtaining prior written permission from the student and/or parent(s) of a dependent minor.

  6. State Licensing Agency Access
    Our school is licensed to operate as a barber college by the SC Department of Labor, Licensing and Regulation (SC LLR) through its SC Board of Barber Examiners.  As such, both SC LLR and the SC Board of Barber Examiners have the right to access a student’s file without obtaining prior written permission from the student and/or parent(s) of a dependent minor.

  7. Vendor Contact Information
    Any information collected from our vendors will be held strict confidentiality. We will share contact information as a recommendation/referral to interested parties seeking to procure a vendor’s services.  Contact information will be retained on all clients in case of an emergency.

  8. Client Contact Information
    We collect contact information from all clients as a part of the initial registration process.  The contact information is maintained in our school records and the contact information is used only in case of emergency (i.e. client information may be shared with emergency first responders).  Top of the Line Barber College will not share or sell client information to any third party for marketing purposes.
